New Jersey’s shortage of residential housing has led to a great deal of legislation focused on hindering the eviction process. In short, a landlord seeking to evict a residential tenant for reasons other than non–payment of rent will need to overcome several procedural hurdles. New Jersey’s Anti–eviction statute provides that a residential tenant may not be evicted except for cause. Causes for eviction can range from a variety of reasons such as non–payment of rent, substantial lease violations, and certain enumerated criminal offenses. Most reasons for termination require that a set of notices be served upon the tenant prior to the filing of an action in tenancy court.
